A BILL to amend article nine, chapter nine of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section seven-a, relating to providing that welfare recipients may work at certain public or nonprofit entities; department of health and human resources to furnish list of welfare recipients available for work; and entities to provide supervision, equipment and materials.

Be it enacted by the Legislature of West Virginia:
That article nine, chapter nine of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section seven-a, to read as follows:
ARTICLE 9. WEST VIRGINIA WORKS PROGRAM.
§9-9-7a. Workforce of welfare recipients to work maintaining certain public or nonprofit entities.
The West Virginia department of health and human resources shall make available to public or nonprofit entities set forth in this section a list of able-bodied welfare recipients who have given permission for their names to be listed as recipients available for such work, and who are available and able to work a minimum of twenty hours a week to perform general labor, maintenance or other similar work. Participating public or nonprofit entities shall provide appropriate supervision, equipment and materials for work performed pursuant to this section. Public or nonprofit entities may not use welfare recipients to displace persons currently employed at such public or nonprofit entities.
Public or nonprofit entities eligible to participate in this program, include, but are not limited to: Public recreation areas and picnic grounds, hiking trails, scenic view areas, battlegrounds and other historic sites, archaeological and geological sites, industrial heritage sites, community sponsored cultural and heritage events and nonprofit public cemeteries.


NOTE: The purpose of this bill is to make welfare recipients available to work at certain public or nonprofit sites.
